Terms of Service

1. Acceptance of Terms

By creating an account or using Stempel ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Stempel is a software-as-a-service (SaaS) tool designed for hospitality businesses — primarily hostels and hotels — to digitise guest check-in by scanning passport data pages with a camera and automatically extracting guest information using AI.

The Service is intended for business use only. It is not intended for personal or consumer use.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when registering and to keep this information up to date.

4. Subscription and Payment

Stempel is offered on a paid subscription basis. New accounts receive a 7-day free trial — no payment is required during the trial period.

After the trial, a subscription is required to continue using the Service. Payments are processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

You may cancel your subscription at any time from within the Settings page. Cancellation takes effect at the end of the current billing period — you will not be charged again after that point. No refunds are issued for partial billing periods.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Scan passports or identity documents without the knowledge and consent of the document holder.
  • Use the Service to process data in violation of applicable privacy or data protection laws.
  • Attempt to reverse-engineer, copy, or resell the Service or any part of it.
  • Use the Service to store data unrelated to guest check-in operations.
  • Share login credentials between multiple properties without a team account arrangement.

6. Data Processing Responsibilities

By using the Service to collect and store guest passport data, you act as the data controller under the GDPR. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining any necessary consent from guests and complying with national guest registration requirements.

We act as your data processor. We process guest data only on your behalf and in accordance with your instructions and our Privacy Policy.

You are responsible for informing guests that their passport data is being scanned and stored digitally, and for providing them access to your property's privacy notice.

7. AI Extraction Accuracy

The Service uses AI to extract data from passport images. While accuracy is generally high, AI extraction is not infallible. You are responsible for verifying the accuracy of extracted data before relying on it for legal or compliance purposes. We are not liable for errors resulting from incorrect AI extraction.

8. Intellectual Property

All rights in the Stempel software, design, and content are owned by us. Your use of the Service does not grant you any ownership rights. Guest data you submit remains yours — we claim no ownership over it.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or compliance failures.

Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the three months preceding the claim.

10. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to perform maintenance, updates, or modifications at any time.

11. Termination

We reserve the right to suspend or terminate your account if you breach these Terms or use the Service in a manner that could cause harm to others or expose us to legal liability.

Upon termination, your access to the Service will cease. You may request an export of your data within 30 days of termination before it is permanently deleted.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in [YOUR CITY], Germany.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notice before material changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
